The user browsing in this area accesses the official website of Sforza S.r.l. (www.sforza.tech). The navigation and transmission of a purchase order on the site involves the acceptance of the Data Protection Terms and Policies adopted by the site itself.
These General Terms of Sale apply to the sale of products with exclusive reference to purchases made on the Sforza website in accordance with the provisions of Part III, Title III, Chief I, Consumer Code (D.lgs. 206/05 modified by D.lgs. 21/14 and D.lgs. 70/03) by:

You are required, before accessing the products provided by the site, to read these General Terms of Sale that are generally and unequivocally accepted at the time of purchase.
You are encouraged to download and print a copy of the purchase form and these General Terms of Sale whose terms Sforza reserves to change unilaterally and without any notice.
You can use the site and then access products provided by the same and purchase these in the following languages:

These General Terms of Sale govern the offer, forwarding and acceptance of purchase orders of products on the seller website Sforza s.r.l. and do not govern, instead, the provision of services or the sale of products by persons other than the seller who are present on the same site via links, banners or other hyperlinks.
Before submitting orders and purchasing products and services from different parties, we suggest that you check their sales conditions.
- 3 Conclusion of the contract
To conclude the purchase agreement, you will need to fill out the form: Checkout electronically and transmit it following the instructions.
It contains the reference to the General Terms of Sale, the price of each product, the means of payment that can be used, the delivery methods of the purchased products and the related shipping and delivery costs.
Before concluding the contract, you will be asked to confirm that you have read the General Terms of Sale, including the Disclosure on the Right to Withdraw and the processing of personal data.
The contract is concluded when the seller receives confirmation through the Electronic Checkout form, after verification of the correctness of the data contained there.
The buyer will be obliged to pay the price from the moment the online order submission process is completed. This will be done by clicking the button: PLACE ORDER at the end of the wizard.
After the contract is completed, the seller takes charge of the order for his evasion.
- 4 Registered users
In completing the registration procedures, the user is obliged to follow the directions on the site and to provide his personal data in a correct and truthful manner.
The confirmation will in any case exempt Sforza s.r.l. from any responsibility regarding the data provided by the user. You are obligated to inform Sforza of any change in your data in any time communicated.
If you then disclose inaccurate or incomplete data, or even if there is a complaint from the parties concerned about the payments made, Sforza will have the right not to activate or suspend the service until the relevant shortcomings are healed.
When the user first requests to activate a profile, the same user name and password will be assigned. The latter recognize that these identifiers constitute the system of validating the user’s access to the Services and the only system suitable to identify the user that the acts carried out through such access will be attributed to him and will be effective.
The user is obliged to maintain the secrecy of his access data and to keep it with due care and diligence and not to give it even temporarily to third parties.
- 5 Product availability
Product availability refers to actual availability at the time the buyer makes the order. However, this availability must be considered purely indicative because, as a result of the simultaneous presence on the site of multiple users, the products could be sold to other customers before the order is confirmed.
Even after the order confirmation email is sent, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically adjusted with the deletion of the unavailable product and the buyer will be immediately notified by e-mail.
If the buyer requests the cancellation of the order, resolving the contract, Sforza will refund the amount paid within 14 days from the time Sforza was aware of the buyer’s decision to terminate the contract.

- 7 Payment methods and prices
The price of the products will be the one indicated from time to time on the site in the main currency: EUR, unless there is a blatant error.
Prices are also available in USD – GBP currency following the daily currency exchange rate on ecb.eu with a surcharge of 2% on the exchange rate.
In the event of an error, Sforza will notify the buyer as soon as possible, allowing the order to be confirmed at the right amount or cancellation. However, there will be no requirement for Sforza to provide what is sold at the wrongly stated lower price.
The prices shown on the site are excluding VAT, they do not include shipping costs. Prices can change at any time. The changes do not affect orders for which order confirmation has already been submitted.
In the case of non-EU countries, VAT is not applied: Vat non-taxable operation Article 8, paragraph 1, letter a) of DPR No. 633/72.
The applicable VAT will be calculated based on the destination status of the goods and will be calculated on the cart page by choosing the shipping location.
Prices also do not include any customs duties and tax for the clearance of goods prior Delivery, which are fully paid by the rceipient of shipments in a foreign Country, not part of the European Union and not part of the agreement on the free movement of goods. Article 26 and articles 28 to 37 of the Treaty on the Functioning of the European Union (TFUE).
Once the products have been selected they will be added to the cart. simply follow the instructions for the purchase, entering or verifying the required information at each step of the process. The order details can be changed before payment.
Payment can be made via the following methods:
- Paypal: for total orders equal to or less than EUR 2000,00 (+1.8% surcharge applies at checkout)
- Bank transfer: use order IDs as a reason for transfer and send bank transfer receipt via email to: sales@sforza.tech
- Cash on delivery : pay by the order amount by cash to the courier at delivery. (surcharge +5.50 €, service available in Italy only)
- Local pick up: payment by bank transfer or cash at collection through Sforza S.r.l logistic address: Via Enrico Fermi 3b, 28100, Novara, Italy. Monday to friday on appointment only.
- Satispay: for total orders equal to or less than EUR 1000,00
- Credit cards accepted ( Stripe Gateway)
- 8 Delivery
Sforza makes shipments with carriers DHL, FEDEX, BARTOLINI -DPD -EUROEXPRESS in the following regions: Worldwide.
Sforza does not ship to companies that provide domiciliation services.
The delivery takes place within the maximum period of 30 working days since the date of payment receival.
If delivery is not possible, the order will be sent to the courier hub. In this case, an email notice will specify where the order is located and how to agree on a new delivery with the Courier in charge of shipment.
If you are unable to be present at the delivery location at the agreed time, please contact the courier in charge to agree on a new delivery date.
If the delivery may not take place for reasons that are not attributable to us after 60 days from the date on which the order is available for delivery, we will assume that you intend to terminate the contract.
As a result of the resolution, the amounts will be returned excluding shipping costs if the order has already been fulfilled and with the exclusion of any additional costs arising from the choice of a method of delivery other than the ordinary method offered without unjustified delay and, in any case, within 14 days of the date of termination of the contract. Transportation resulting from the termination of the contract may have additional costs that will be borne by the buyer.
The shipping costs are charged to th buyer and are explicitly highlighted at the time of placing the order.
- 9 Risk Passage
Product risks will be passed on to the buyer from the time of delivery. Ownership of the products is considered acquired as soon as received the full payment of all the amounts owed in relation to them, including shipping costs, that is, at the time of delivery, if it were to take place at a later date.
- 10 Warranty and Commercial Compliance
The seller is responsible for any defect of the products offered on the site, including the non-compliance of the items to the products ordered, according to the Italian regulations.
If the purchaser has entered into the contract as a consumer or any individual acting on the site for purposes unrelated to the business or professional activity, this guarantee is valid provided that the defect occurs within 12 months of the date of delivery of the products; that the buyer submits a formal complaint regarding the defects within a maximum of 15 days from the date on which the defect was recognized by the latter.
In the event of non-compliance, the purchaser who entered into the contract as a consumer will be entitled to the reinstatement of product compliance without charge, either by repair or replacement, or to obtain an appropriate price reduction or the termination of the contract in relation to the disputed goods and the consequent return of the price.
All return costs for defective products will be incurred by the seller.
- 11 Return
In accordance with the legal provisions in force in European Union, the purchaser who has received theproducts in one of the EU Countries, is entitled to withdraw from the purchase without any penalty and without specifying the reason, within 14 days under art. 57 of D.lgs 206/2005 since the date of receival of products.
In the case of multiple purchases made by the buyer with a single order and delivered separately, the 14-day deadline starts from the date the last product was received.
The buyer wishing to exercise the right of withdrawal must notify Sforza by explicit declaration, which can be transmitted by writing an email to : sales@sforza.tech
The buyer must also exercise the right of withdrawal by sending any explicit declaration containing the decision to withdraw from the contract or alternatively submit the form of withdrawal type, referred to in Exhibit I, Part B, D.Lgs 21/2014 not mandatory.

The goods must be returned undamaged, in the original packaging, complete in all its parts and complete with the attached tax documentation. With the benefit of the above, Sforza will refund the amount of the products subject to the withdrawal within a maximum of 14 days, excluding shipping costs.
As required by art. 56 paragraph 3 of D.Lgs 206/2005, amended by D.lgs 21/2014, the site may suspend the refund until the goods are received or until the buyer has demonstrated that they have returned the goods.
Sforza will make the refund using the same payment method chosen by the buyer during purchase. In the case of a bank trasnfer/cash on delivery payment and if the buyer wishes to exercise his right of withdrawal, he or she must provide the bank details: IBAN, SWIFT and BIC required to make the refund.
The right of withdrawal without any penalty and without specifying the reason does not apply to orders shipped to foreign Countries not part of the European Union, therefore the International returns are not accepted, without prejudice of nonconforimg products received. Customs duties & tax paid by the buyer for clearance in the delivery Country are at buyer charge entirely and therefore not refundable by the seller.
- 12 Data processing
The buyer’s data is processed in accordance with the rules on the protection of personal data, as specified in the appropriate section containing the information under art. 13 D.lgs. June 30, 2003 (Privacy Policy).
- 13 Safeguard clause
In the event that one of the clauses of these General Terms of Sale is null and void for any reason this will in no way compromise the validity and compliance of the other provisions in these General Terms of Sale.

- 15 Applicable law and competent forum
These General Terms of Sale are governed by Italian law and interpreted according to it, except for any other imperative prevailing rule of the country of habitual residence of the buyer. As a result, the interpretation, execution and resolution of the General Terms of Sale are subject only to Italian law and any disputes inherent and/or resulting from them must be resolved exclusively by the Italian court. In particular, if the buyer is a Consumer, any disputes must be resolved by the court of the place of residence or residence of the same under applicable law.
